2. Definitions

Loa Amsterdam: Refers to Loa Amsterdam B.V., the seller of the products.

Customer: Any individual or entity purchasing products from Loa Amsterdam.

Distance Agreement: Any purchase agreement concluded through the Loa Amsterdam website or other electronic means.

Products: All items offered for sale by Loa Amsterdam, including swimwear and related items.

3. Applicability

These Terms & Conditions apply to all offers, agreements, and transactions conducted through the Loa Amsterdam website.

By placing an order, the Customer agrees to these Terms & Conditions.

Deviations from these Terms & Conditions are only valid if agreed upon in writing by both parties.

If any part of these Terms & Conditions is deemed invalid or unenforceable, the remaining provisions will remain fully applicable.

4. Right of Withdrawal (Returns Policy)

Customers have the right to cancel their order within 21 days after receiving the Products, without giving a reason.

Customers must return the Products within 21 days after cancellation. The Products must be unused, in original condition, and with all tags attached.

Return shipping costs are the responsibility of the Customer, unless the Product is defective or incorrect.

Refunds will be processed within 3 days of receiving the returned Products or proof of return, whichever is earlier.

5. Products and Warranty

 Loa Amsterdam guarantees that its Products meet the specifications described on the website and are free from defects.

Complaints about defective Products must be reported in writing (via email) within 48 hours of receiving the Product. 

Warranty claims are void if the Products are damaged due to improper use, exposure to chemicals (e.g., sunscreen or chlorine), or third-party repairs.

 Sale items with a discount of 50% or more are not covered by the warranty.

6. Delivery Terms

Loa Amsterdam aims to deliver orders within the communicated timeframe. However, delays may occur due to unforeseen circumstances. 

Customers will be notified if delays arise. Loa Amsterdam is not liable for delays caused by events outside its control (see Force Majeure). 

Ownership of Products transfers to the Customer once full payment has been received. The risk of loss or damage passes to the Customer upon delivery.

7. Complaints

Complaints must be submitted in writing to contact@loa-amsterdam.com within 48 hours of receiving the Product. 

Loa Amsterdam will respond to complaints within 14 days of receipt.

If additional time is needed, the Customer will be informed. Loa Amsterdam strives to resolve complaints through mutual agreement.

8. Liability

Loa Amsterdam is not liable for indirect or consequential damages, including loss of profit, missed opportunities, or damage caused by misuse of the Products.

 Liability is limited to the value of the Product purchased, unless otherwise required by law.

Loa Amsterdam is not responsible for damage caused by external factors such as chemicals, sunscreen, chlorine, or improper care.

9. Force Majeure

Loa Amsterdam is not responsible for delays or failure to fulfill obligations due to circumstances beyond its control, including but not limited to natural disasters, strikes, or transportation disruptions.

10. Privacy

Personal data collected during the ordering process will be processed in accordance with Loa Amsterdam's Privacy Policy

Loa Amsterdam ensures that personal data is handled securely and will not be shared with third parties without consent.

11. Governing Law

These Terms & Conditions are governed by the laws of The Netherlands.

Any disputes arising from these Terms & Conditions will be resolved by the competent court in Amsterdam.
